1. ACCEPTANCE:  The most current version of the Terms can be accessed here.  When using services, you are subject to any posted guidelines, rules, and restrictions which will be kept updated.  If you do not agree or choose to abide by these limitations, do not use this website.
2. PERMITTED USE:   You are allowed to visit, view and retain pages for your own personal use and that you shall not duplicate, download, publish, modify or release material for commercial use for any purpose other than as described in these terms.
3. CONTENT:    You understand all materials posted or linked to from this site are the responsibility of the person(s) from which the content originated.  You are responsible for all content when you make comments or send emails through the site.  The Brasharian does not control or is responsible for content made available and some material may be offensive, indecent, inaccurate, misleading, or objectionable.  The content made available through the site may provide links to other websites, which are not owned or operated by The Brasharian.  All material posted on this site will attempt to be as accurate and authentic as possible, but The Brasharian is not responsible for information contained on other sites linked to that are independent of this blog.  It is the reader/user’s responsibility to evaluate and bear all risks associated with the use of any content and its reliability.  The Brasharian is not responsible or liable for links users post as comments, nor is The Brasharian liable for any content created or loss/damage of any kind incurred as a result of the use of content posted, emailed or made available through the service.  You acknowledge that The Brasharian may or may not pre-screen or approve content, but we shall reserve the right at our sole discretion to refuse, delete, edit, or move any content through the site that is in poor reflection of the site or violates the Terms of service for any reason.
4. PRIVACY:  A full privacy policy can be viewed in the PRIVACY STATEMENT and is to explain to users that the information that is collected and used will not be sold, rented or released to marketing firms or outside companies.  Your use of this website signifies that acknowledgement and agreement and when you use this site for service or content, and that all private information will be kept in storage and used only for the services in this site and direct affiliates.
5. CONDUCT: You agree not to post, submit or create content that:
   1. Is unlawful, harmful, threatening, abusive, harassing, defamatory, pornographic, libelous, or invades another’s privacy or harms minors.
   2. Harasses, insults, intimidates or is hateful to an individual or any group of individuals based in individual differences.
   3. Impersonates a person or entity such as a company employee or falsely states/misrepresents your affiliation with said person/entity.
   4. Includes personal or indentifying information about other people without that person’s permission.
   5. Infringes any legally protected content that you do not have permission to make available.
   6. False, deceptive, misleading, deceitful, or misinformative.
   7. Constitutes as “spam”, “junk mail”, “chain letters”, “pyramid schemes” or unsolicited content.
   8. Contains any advertising that will be published or emailed.
   9. Contains links to commercial services or websites, more specifically to those who have requested not to be contacted about other services, products, or special interests.
   10. Contains software viruses, programs or code designed to harm, destroy, limit functionality of any software/hardware equipment.
   11. Floods comment fields or negatively affects another users’ ability to use the site.
   12. Employs misleading or forged email address and subject lines or text meant to be misleading.

You also agree not to:

• Contact those who have requested not to be contacted
• Stalk or harass
• Collect personal data for commercial or unlawful purposes
• Use technology to download data from the service, unless you have been given permission to work with this site.
• Post irrelevant content or repeatedly post the same content or impose an unreasonable large load on our server infrastructure.
• Attempt to gain unauthorized access to The Brasharian’s computer systems or engage in any activity that disrupts/diminishes quality of, interferes with performance, or impairs the functionality of the website.

1. NO SPAM:   You understand and agree that sending unsolicited email advertisements to The Brasharian email addresses.
2. LIMITATIONS:   You acknowledge that we may establish limits concerning use of this site, including maximum number of days content will be kept, maximum number and size of comments and postings, email messages or content that may be used or stored by the site, the frequency with which you may use the site.  You agree that The Brasharian has no responsibility or liability for the deletion or failure to stare and content featured on this site.  We reserve the right to discontinue your service with or without notice and The Brasharian shall not be liable to you or third party members for any modification or restricted use of the site.
3. SERVICE TERMINATION:   The Brasharian has the right to delete your account, block your email or IP address, in other words, terminate your accessibility and usability immediately and without notice and remove/discard any content within the site for any reason.  The Brasharian shall not be liable to you or any third party in regards to termination.
4. OWNERSHIP RIGHTS:   You agree not to modify, rent, lease, loan, sell, distribute, or utilize any content or merchandise for commercial purposes or create works based on The Brasharian brand.  You may not disassemble, edit, engineer, or attempt to discover source code contained on this site.  Content that is submitted to The Brasharian site becomes sole ownership to The Brasharian and those who submit their work forfeit ownership rights of aforementioned content.  This means The Brasharian site and its affiliate parent and subsidiary companies/networks, have unrestricted and exclusive rights to reproduce, modify, translate, transmit, create works of, include in other works, and distribute all materials regarding submitted content.
5. USER COMMENTS:    Content such as posts, comments, and emails produced by users, readers, and subscribers do not reflect the views or opinions of The Brasharian site, its affiliates or staff.  The Brasharian site does not presume responsibility or liability for any claims, damages or losses from any use of this site or materials that are found in the site.
6. PROCEDURE FOR IP AND COPYRIGHT CLAIMS:  All images and videos are carefully researched and collected for use as deemed appropriate and responsible by the Creative Commons fair use agreement and when in doubt, permission is requested.  If you believe that anything on the site infringes upon any copyright which you own or control, you should file a notification with staff by email.  In your notice;
   1. Identify the copyrighted work/property you believe has been inappropriately used and describe the material on The Brasharian site so that we may find it including Title and Publish Date.
   2. A short statement describing that you have a good faith belief that the use is not authorized by the owner, its agent, or the law.
   3. A second statement saying your information is accurate and that you are the owner or that you are authorized to act on behalf of the owner.
   4. Your name, phone number, mailing address, a second contact email address, and a an electronic signature.
   5. You agree that The Brasharian site is governed by the laws of the State of South Carolina and applicable to agreements made to be preformed within the State of South Carolina.  You agree that any action at law or in equity arising out of or relating to these conditions shall be filled completely and exclusively in the state and federal courts located in Greenville County, South Carolina.  You consent to submit the exclusive jurisdiction of such courts over any suit, action, motion, or proceeding arising out of these terms.  You also grant The Brasharian protection from any legal and court fees incurred on the side of the accuser.  You agree that regardless of any law, statute, clause or footnote, any claim or cause of action arising from or related to the use of the site or its terms must be filled within one (1) year after such claim or cause of action arose will be forever barred.
